I would appreciate some quick assistance to any cases. A Sierra Leone couple fear return because their second daughter of 10 would be at threat of FGM if returned. (An older daughter was forced to be circumcised.)
The UKBA argues since the father does himself fear no persecution, the case does not fall within the Convention.
I think it was during the 1980s I made a declaration for a Nigerian woman in, I think, Seattle, Washington on exactly the same grounds, that she (already 'circumcised herself) feared FGM for her daughters. Lawyers rarely report results of cases, but years later I was told by a Canadian lawyer, that this case became the precedent case for such cases in Canada and the US. I don't have much time, but would greatly appreciate help in locating this and any other related cases. (I am doing this pro bono.).
And the argument that he fears no persecution (proven by trips to Sierra Leone during his studies in the UK), but his child fears 'inhumane and degrading treatment', so that the cases does not fall under the Convention, seem spurious?
