The best way to start a Monday morning is with a question about copyright! Isn’t it?
I am developing our sport collections within the archive and am in the process of setting up a rolling deposit agreement with a sporting league. An issue has arisen with our standard deposit agreement and the reference to copyright. A number of depositors are unhappy assigning copyright to the archive due to a number of issues. One important issue is that there are a number of external agents that they work with, such as photographers working at matches and artists that produce publicity material. The depositors have a policy of allowing copyright to remain with the creator, as they’re entitled to do – most of these external agents are also volunteers. Unfortunately we do not have the resources to contact every single individual to ask them to sign a copyright release form. There is no guarantee that they would do this either. I’m not entirely sure this would be the best approach to the problem either.
One compromise raised in discussions is the use of a permanent license outlining what we can and cannot do with the material. I am not very experienced in this area so any help or advice would be appreciated.
