Dear friends of Inclusion Europe,
The rights of people with disabilities are enjoying better recognition these days as the European Court of Human Rights has positioned itself firmly against institutionalisation and the use of physical restriction in care on people with intellectual disabilities.
New technologies and the internet are definitely contributing to this advancement and organisations have taken advantage of this, as for example CERMI with the development of a smartphone application to report infringements of rights of people with disabilities.
However the risk of these new tools should not be ignored, especially concerning the younger population, and Mencap’s new guide for online safety will surely be put to good use by parents of children with intellectual disabilities.
It is important not to forget that even though progress is being made for a greater realisation of the rights of persons with disabilities, mobilisation of DPOs remain crucial as we are not to be shielded from regression in this domain, as pointed out by IDA in regard to recent UN draft resolution.

IDA critical of UN resolution proposal
The International Disability Alliance (IDA) urged UN Member States not to adopt a resolution which would undermine the Convention on the Rights of Persons with Disabilities. IDA expressed its deep concern that the UN General Assembly Social, Humanitarian and Cultural Committee might adopt a resolution which endorses the outdated World Program of Action for Disabled Persons (1982).

The European Court of Human Rights critical of institutional care
The European Court of Human Rights delivered a judgement on the 16th of October 2012 stating that the privation of liberty for institutional placement of a person with disability against his/her will and for an undetermined period of time constitutes a violation to the European Convention on Human Rights.

Use of restraint on people with disabilities is considered inhuman treatment by ECtHR
The European Court of Human Rights (ECtHR) held in the recent case Bureš vs Czech Republic that both the application of restraint on a person with mental disability and the State’s failure to take measures to prevent torture and ill treatment constitute serious infringements to the European Convention on Human Rights.

CERMI launches application to report human rights violations
The Spanish Committee of Representatives of Persons with Disabilities (CERMI) has developed an application for smartphones and other mobile devices in an effort to fight for a more inclusive society, based on the respect of the rights of all people. This application allows mobile device users to report infringements to the rights of people with disabilities.

Special Rapporteur on violence against women speaks about violence against women with disabilities
A report submitted to the General Assembly by the Special Rapporteur on violence against women, its causes and consequences, Rashida Manjoo, provides an overview of the issue of violence against women with disabilities. The report states that women with disabilities experience both the stereotypical attitudes towards women and towards persons with disabilities which put them at high risk of being subjected to violence and abuse.

You and your baby: a guide for parents with intellectual disabilities
The British organisation Change has published, together with UNICEF, a new edition of their book ‘You and your baby’, a resource to support parents with intellectual disabilities. The 370 page easy to read book can be used to support parents in taking care of their growing baby. It covers a wide range of topics such as feeding, hygiene, safety, teething, health checks and managing baby’s routines.
