Unfortunately the fact is that if she wasn't managed previously then the Perceived protection from her pregnancy may appear to be unfair but it is the law also it is not OH issue but a management one we must stick ti fitness for work advice leave policy and procedure to HR if they had robust policy then slowly slowly catch the monkey

Hi Janet,
She has been managed on some levels but has just slipped under the radar she has been on a stage 1 and 2 and any normal absence would have triggered a stage 3 which can lead to dismissal but as she has cited nausea it is pregnancy related. I don't have an issue with her but I feel that nausea can be mild to severe and does not always mean you can't work. She does not work with food and there are no strong odors' hence wishing to see her.
She has been off 4 weeks now...

Whilst if she is off with a pregnancy related illness she is "protected" if she is having unrelated absence she can still go down the disciplinary route however it seems unethical if she wasn’t absence managed from the start.

If she is not responding to requests to be assessed then it ought to be an HR issue. They are probably right to be cautious in moving further with the disciplinary process and pregnancy does afford much legal protection but I don't think this makes her untouchable.

Hi All,
Just want to ask if anyone has ever seen a case where a person who had very poor attendence over several years and then became pregnant and was off a lot then returned and resumed poor attendence then when they had progressed on the disiplinary stages they became pregnant again whether they could lose their job?
In essence does pregnancy totally protect a person from losing their job based on attendence?
Has anyone else had a case like this and if so how did they approach it?
HR seem to say they are untouchable... Seems like they are taking the Father Michael..
I have never had such a poor attending employee who was pregnant before. I am sure they do have morning sickness ( as did I ) but it does not always prevent attendence and they are not responding to requests to be assessed.....
Help please.
