Seeking copies of refugee determinations on the basis of gender, sexual orientation and gender identity.
Jenni Millbank (UTS) and Catherine Dauvergne (UBC) are undertaking a large comparative project on gender related persecution. One aim of the project is to gather the broadest and most representative possible collection of gender based refugee cases of significance in any language. We are particularly interested in gathering unreported decisions from lower levels of courts and tribunals and cases from countries that do not routinely release written decisions.
If you have access to refugee determinations concerning gender-related persecution (including on the basis of sexual orientation or transgender status) that are not publically available we would be very grateful if you would email them to [log in to unmask] including a short note on your role, if any, in the case and why you believe the case to be significant – ie the first of its kind to establish X or Y in your jurisdiction. Please specifically note if the material has yet to be de-identified or is in any way confidential. One aim of our project is to make a useful set of cases openly available worldwide, but we undertake not to make any case or any part of a claim public prior to establishing with providers that the material is appropriately de identified and acceptable to release (eg that the claim has been finalised).
