Cathryn Costello will present "The Court of Justice of the EU and European Court of Human Rights as Refugee Law Courts"

Abstract:
Both the EU Court in Luxembourg (CJEU) and the European Court of Human Rights in Strasbourg (ECtHR) deal with increasing volumes of refugee law cases. While the jurisdictions of the two Courts increasingly overlap, the two courts are in different institutional positions and dispose of different degrees of decisional autonomy. In addition, the Refugee Convention occupies a different position under EU law than under the ECHR regime. While it is effectively written into EU law, it merely forms part of the background of states' international obligations for the ECtHR. This presentation surveys these institutional differences and uses them to explore the divergent refugee case law of the two courts. 

Bio:
Cathryn Costello (B.C.L., (N.U.I.), LL.M. (Bruges), B.L. (Honorable Society of King's Inns), DPhil (Oxon) is Fellow and Tutor in EU and Public Law at Worcester College. She tutors Constitutional and EU law and also teaches parts of the BCL International and European Employment Law course and on the MSc in Migration Studies. From 1998-2003 she was Lecturer in European Law at the Law School, Trinity College Dublin. From 2000-2003, she also held the position of Director of the Irish Centre for European Law. She has been a Visiting Professor at the University of San Francisco and visiting research fellow at NYU School of Law. She has assisted a number of NGOs in the immigration and asylum fields, and was a member of the Board of the Irish Refugee Council and the Steering Committee of the Immigrant Council of Ireland. She is currently on ILPA's (Immigration Law Practitioners' Association) European Group. She specialises in EU law, and has completed a DPhil on EU immigration and asylum law.  She also writes on EU constitutional and equality law.
