Yes I looked at this case in depth when I did my certificate in OH Law.
It certainly made me come back and look carefully at the emp medical
questionnaire that I use. It also raises questions as to how the answers
provided can be highly relevant for an employer in seeking to meet its
obligations to make reasonable adjustments for a disabled employee under
the EQA and whether the 3 or 4 question questionnaires would actually be
sufficient in some cases.
