My take is that individuals need to be advised adequately so that they make informed decisions. If they insist that they are not happy to complete the form then it becomes a management issue. All we can do is advise management to seek further advise from H&S colleagues who will be able to advise on risk assessments and safe working practices(there may be need for further controls to be put in place).
I suppose it's their right to refuse despite their previous agreements with management. As long as we can demonstrate that we have given that individual every opportunity to engage in the process. As OH we are impartial and as such we need to ensure the impartiality by respecting their decisions regardless of what we consider is right or wrong. Sometimes employees refuse because of myths they have heard on the shop floor or there may be some history which might need to be addressed. I once had a clients who were refusing yo have a respiratory test done because the last time it was done the company made some redundancies and they presumed that the results of the tests were used as a redundancy criteria.
When all is said and done it's up to management to deal with it!.
