The so-called No Taxpayer Funding for Abortion Act is approved along party

Reporting from Washington The House of Representatives on Wednesday
approved a sweeping antiabortion package to further distance federal funds
from the procedure by solidifying existing measures and imposing new ones.
.
The measures stand little chance of approval by the Senate, but again
demonstrated the key role social issues still play in unifying the
Republican Party.
.
Dubbed the No Taxpayer Funding for Abortion Act, the bill was approved
along party lines and endorsed by longtime abortion foes and the House
Republican leadership, despite arguments that GOP lawmakers should keep a
narrow focus on budget and spending issues.
.
Republicans demanded the antiabortion measures as part of contentious
budget discussions earlier this year, nearly tanking bipartisan talks and
risking a government shutdown. The provisions were removed in a deal with
the White House to enable passage of the budget measure on the condition
that a separate vote be held later to allow members to express their views
on the record.

The House bill would permanently place into law current policies
prohibiting federal money from paying for abortions through Medicaid and
some other federal programs. The policies, primarily outlined in the
decades-old measure known as the Hyde Amendment, must be periodically
renewed.
But the bill also goes further to eliminate what supporters say are
indirect federal subsidies for abortion providers.

Under the measure, businesses that offer health insurance policies
covering abortion could not recoup tax credits under the new healthcare
law. In addition, individuals could not deduct the cost of an abortion
when itemizing health expenses on their taxes, nor could they use a
tax-exempt savings account to pay for an abortion.

The House approved a bill Wednesday that would make permanent a ban on the
District using its own money to fund abortions for low-income women,
dealing D.C. another setback in its quest to retain control over its
finances.

The No Taxpayer Funding for Abortion Act cleared the House on a 251-175
vote, with 16 Democrats joining all 235 Republicans present to support it.
The bill would tighten laws designed to prevent federally-funded abortions
across the country, and would enshrine the District ban into federal law.
The spending resolution signed by President Obama last month contains a
similar restriction on D.C., but it only lasts through Sept. 30.

The House bill is unlikely to come up in standalone form in the Senate,
where Democratic leaders are opposed. Obama has also threatened to veto
the measure, in part, the Office of Management and Budget says, because it
restricts the District of Columbias use of local funds, which undermines
home rule.

The language used in this bill converts the District into a Federal
property for the first time in its history, Mayor Vincent C. Gray wrote in
a letter to members of Congress Wednesday. This unprecedented affront to
the sovereignty of a local and state government would never be
contemplated anywhere else in the United States. Yet, the District is
particularly singled out in the bill for such treatment.

city council sent Tuesday.

The new Republican majority's agenda is pretty clear when you look at
their list of legislation this Congress:
.
H.R. 1 -- decimate the programs that millions of middle-class families
across the country depend on.
.
H.R. 2 -- repeal the landmark law that expands health care to millions of
Americans and prevents big insurance companies from discriminating against
people when they get sick.
.
And then, of course, there's H.R. 3, which would restrict women's rights
to make their own health decisions and roll back the rights of women by
decades.
.
These three bills read like a "to do" list for the Republican Party. And
today, that third item is dangerously close to becoming a reality.
.
H.R. 3 is deceptively titled as the No Taxpayer Funding for Abortion Act.
Yet it has nothing to do with federal funding of abortions -- an issue
that was put to rest for years by language in the Hyde Amendment that
prohibits taxpayer dollars from funding abortion procedures. But for some,
that simply isn't enough. Since they continuously cannot muster the
support to ban abortion outright, they instead attempt to make abortion
care as difficult as possible. In this case, H.R. 3 attempts to manipulate
the tax code to deny small businesses tax credits if they provide their
employees with comprehensive health care, permanently bans abortion care
for federal employees, and potentially subjects victims of rape and incest
who have sought abortion care to IRS audits.

But the bill's name isn't the most deceptive or egregious part of it. H.R.
3 truly represents an unprecedented rollback of women's rights by sneaking
in a backdoor provision to reintroduce language that redefines rape. You
might have heard about it on The Daily Show. And indeed, it would be a
laughable concept if it weren't so serious. Just earlier this year, facing
a backlash from women and voters across the country, Republicans removed
the ludicrous and now-infamous "forcible rape" language, which would have
completely changed the definition of rape.

But while they removed that particular language, House Republicans have
now reinserted a provision with the same intent into the bill's committee
report - meaning the outcome will essentially be the same: Republicans are
narrowing the definition of rape so they can restrict rape victims'
ability to obtain an abortion. They're just trying to hide this deeper in
the bill's 'fine print.'

The truth of the matter is that H.R. 3 breaks sharply with longstanding
federal abortion policy in ways that could significantly impact people's
health insurance and set a precedent that jeopardizes federal funding for
many faith-based organizations. Proponents of the legislation claim it
will permanently codify the Hyde Amendment, which is renewed annually and
prohibits federal funding of abortion services except in the case of rape,
incest, or to protect the life of the mother. But H.R. 3 would also create
financial penalties for individuals whose insurance plans cover abortion
services (something the majority of insurance plans currently do, and have
done without arousing controversy during pro-choice and pro-life
Presidential administrations in the past). The bill would discontinue all
tax subsidies to private health insurance plans that cover abortion, even
if abortion coverage is entirely paid for by private funds, and it would
impose tax penalties on those that pay for abortion coverage. In other
words, it would create incentives for health insurers to not cover
abortion services at all. Pro-life leaders who support this tax increase
and departure from the status quo should say so.

WASHINGTON - A closer look at a House bill marketed to the public as a
"common-sense" ban on taxpayer-funded abortions reveals an aggressive,
multi-pronged effort to restrict insurance coverage for and reduce access
to abortion.
.
H.R. 3, also known as the "No Taxpayer Funding for Abortions Act," would
go beyond making the Hyde Amendment, which has already banned
federally-funded abortions for the past 30 years, a permanent federal law.
The legislation, sponsored by Reps. Chris Smith (R-N.J.) and House Speaker
John Boehner (R-Ohio), would also enact strict procedural requirements for
private insurance companies that cover abortions and deny tax credits to
small businesses that purchase health insurance plans offering abortion
coverage. Eight-seven percent of private insurance plans currently include
such coverage.

Further, H.R. 3 would eliminate privately funded insurance coverage for
abortion in the state-based exchanges set up by the Affordable Care Act.
The policy team at NARAL Pro-Choice America estimates that 13.5 million
women who receive health coverage through Medicaid and other
government-sponsored programs would permanently lose access to abortion
coverage if the measure, facing a floor vote Wednesday, passes.

Some of the more extreme ramifications of the bill, which have attracted a
great deal of negative media attention since its introduction in January,
include a provision that could subject victims of rape and incest to
abortion audits by the IRS. Mother Jones reported in March that H.R. 3
could turn IRS agents into "abortion cops" tasked with determining whether
a woman used any kind of tax benefit to pay for a procedure not
precipitated by rape or incest.

Marcus Owens, a former longtime IRS official, told Mother Jones that if a
woman received a tax credit for medical costs related to abortion, "on
audit [she] would have to demonstrate or prove, ideally by contemporaneous
written documentation, that it was incest, or rape, or [her] life was in
danger. It would be fairly intrusive for the woman."

H.R. 3 has achieved further notoriety through its attempt to narrow the
definition of "rape" as it relates to abortion. Lawmakers pulled language
from the original measure that allowed federal funding for abortions only
in the case of "forcible rape" after drawing widespread public criticism,
but Mother Jones reported on Tuesday that House Republicans are using a
backdoor legislative maneuver to ensure the bill achieves the same effect.

The socially conservative Family Research Council Action's Super PAC is
launching radio ads in six Democratic and six Republican congressional
districts, pushing House members to vote for H.R. 3, the No Taxpayer

Reproductive Rights activists, including Feminist Majority Foundation
organizers, and members of the organizations DC Vote and the DC Abortion
Fund, along with several city council members, protested the bill on
Wednesday evening at Capitol Hill. The protest was focused on HR3's
permanent ban on the District's ability to use local funds for abortions,
as well as the general federalizing of D.C. government and funds. Council
member Mary Cheh and 7 other women activists were arrested for blocking
traffic during the protest. The groups hope to continue putting pressure
on Congress and plan to hold a similar protest next Wednesday, May 11.

"True to form, the House majority has cast a wide net in its attack on

While so much attention has been paid to the death of Osama Bin Laden, yet
another Republican House majority attack on civil liberties has moved
forward under a new guise. Introduced in the House back in January and
renamed H.R.3 to symbolize its importance, the No Taxpayer Funding for
Abortion Act made its way through committees to the House floor on
Wednesday. Not surprisingly, it passed. Essentially, the bill codifies
what has already been practice, which is to bar federal employees, members
of the military and those who receive federal assistance from using
taxpayer money to pay for abortions, with few exceptions.

It is an end sweep of the 14th Amendment as well as Roe v Wade, and it
re-regulates womens reproductive rights in the process.
.
A top priority of Republican leaders, specifically co-sponsors John
Boehner and Eric Cantor, under the language of H.R. 3, rape becomes
"forcible rape." Presumably that modifier distinguishes it from other
kinds of sexual assault that are typically recognized as rape, such as
statutory rape and attacks that occur because of drugs or verbal threats.

How do Republican women sleep at night? How does one get up in the
morning, look in the mirror and justify voting to make a mentally
deficient 14-year-old give birth because she didnt understand what her
boyfriend was doing? How does she justify voting to ignore drugs slipped
into a drink as equal to a knife or a gun in a rape? How does she justify
saying that a woman cannot claim she was raped at gunpoint or knifepoint
unless she is critically injured or killed fighting back? How many stab
wounds, broken bones, bruises, or bullet holes are required to prove
forcible rape? Does it feel good knowing you protected the life of a
pre-born child in the womb of a young woman in a persistent coma caused by
Rohypnol?
We all thought that the language restricting the definition of rape to
forcible had been deleted from Rep. Chris Smiths heinous No Taxpayer
Funding For Abortion Act, but while the language is not technically in the
bill that passed the House of Representatives last night, there is a
backdoor reintroduction of that language. If the bill is challenged in
court, the judges will have to look at the congressional committee
proceedings to determine exactly what is intended in the bill and what is
intended is a restriction on abortions except when the mothers life is
demonstrably in danger or the rape victim can prove that she fought back.
Of course, if she fought back enough to meet Smiths requirements, the rape
would be investigated as a murder, so no abortion would be called for.

One of the biggest issues facing caregivers and teachers is the fact that
these teens have all the hormones of average teens with no capacity for
understanding the implications of their actions.

Or how about the unpopular 14-year-old who suddenly finds herself being
courted by the 18-year-old football star. Hell go to jail for a few years
for statutory rape, but shell never finish high school and spend 18 years
trying to raise his kid on minimum wage jobs.

Nearly 135,000 signatures on a petition opposing H. R. 3 did nothing to
stop House Speaker John Boehner holding the vote last night. Sixteen
anti-choice Democrats joined the House Republicans in passing this bill,
which stands no chance of getting past the Democratic Senate or the
President. There was even a threat to hold the debt ceiling increase vote
up unless this bill was voted on and passed.

In their, zeal to restrict womens health care, today he voted to place new
restrictions on how women with private insurance can spend private dollars
in purchasing their own health insurance, read the release. This is yet
another example that [Fitzpatrick and Meehan]s agenda is about advancing
right-wing social issues rather than creating jobs.

Its too early to tell how the issue will play back home, but it would seem
that Republicans have the upper hand in the messaging battle in
Pennsylvania.

All of Pennsylvanias Republican delegation voted in favor of the bill, and
more PA Democrats voted for it than Democrats from any other state. Reps.
Jason Altmire, Mark Critz and Tim Holden all voted for the proposal.

A day after joining just four other Democrats in voting for a health care
reform defunding bill, conservative Democrat Jason Altmire yesterday again
voted with Republicans to bar taxpayer-funded abortions.

This time he was one of one of 16 Dems to cross party lines, and was
joined by (possible 2012 primary rival) Mark Critz of Johnstown.

This is a democracy and he's an elected official. So if you had thoughts
(either way) about this bill and its redefinition of rape and how it turns
the IRS into "abortion cops", you have the right to discuss those thoughts

The idea that a woman has to document her rape or incest incident in order
to receive tax credits is not only absurd it is also psychologically
damaging. There is no reason why a woman should have to revisit an
emotionally traumatic experience for financial reasons. When, or if, these
examinations are conducted, how can abortion cops decide who receives
these credits and who doesnt? This is precisely why there has been such
opposition to the bill. It attempts to redefine rape according to the
subjective interpretation of certain government officials, simply for the
purpose of maintaining a tighter grip on tax credits.

Passing the No Taxpayer Funding or Abortion Act does not improve the U.S.
economy, nor does it solve any of the educational crises. It serves no
real function except to slight women of their sexual autonomy in favor of
a growing conservative movement and define the context under which
abortions are reasonable. If House Republicans were truly invested in
fiscal responsibility and representing the common person, they would not
produce a bill that robs women of already limited medical choices.

Although President Obama twice voted against taxpayer-funded abortion in
the District of Columbia when he served in the Senate, he is threatening
to veto the legislation if it receives final passage in the Senate.

The administration will strongly oppose legislation that unnecessarily
restricts womens reproductive freedoms and consumers private insurance
options, the White House said in a statement. If the President is
presented with HR 3, his senior advisers would recommend that he veto the
bill.

Congress has passed temporary bans since 1976, tacked onto annual spending
bills authored by former Rep. Henry Hyde (R. Ill.). The language exempts
cases of rape, incest, or when the mothers life is in danger.

The bill bans abortions in military hospitals in the U.S. and abroad.
.
The legislation also eliminates tax breaks for businesses offering
insurance that pays for abortion, which Democrats said amounts to a tax
hike.

It turns the tax code into a moral code, said Jackie Speier (D. Calif.).
Many people are opposed to profanity, maybe we should make that illegal
when filling out taxes.

Responses to the passage of the bill by women's rights and reproductive
rights groups was unanimous. Stephanie Schriock of EMILY's List stated,
"Republican leaders once again showed American women they care more about
taking away their access to health care than they do about creating jobs.
The economic recovery they campaigned on was just the first half of a bait
and switch. Turns out, the number one GOP priority is an obsession with
taking away women's freedoms and their opportunities to keep themselves
and their families healthy."

Nancy Keenan, president of NARAL Pro-Choice America, said "Despite facing
intense public backlash for bringing the government to the brink of
shutdown over defunding Planned Parenthood, Speaker Boehner and his allies
have resumed their War on Women with the passage of H.R.3. This bill is so
extreme that it manipulates the tax code to advance anti-choice policies
and could spur the IRS to audit rape and incest survivors who choose
abortion care."

vote is a rejection of the values that the Republican Party claims to
represent. What is Republican about its leadership's obsession with the
private healthcare decisions that women make? The Republican Party's
platform calls for 'improving public health through flexibility and
innovation' and 'giving patients and providers control over treatment
options.' How does this move improve public health? How does it give women
more control over their treatment options? Where does the platform state
that we must destroy the social supports on which the less well-off rely?
Finally, I must ask why the Republican elite is obsessed with the
decisions that women and their partners make about whether to start or
continue a pregnancy.
