They can download all the statutory stuff from MAGIC and the new National Heritage List, so should be doing that themselves if they're not going to pay you to extract it! Locally listed buildings are perhaps different, unless they too are available to download off the web somewhere.
As I understand it if you have a reasonable charging scheme in place, preferably as part of a local authority 'Publications Scheme' (sorry, I don't have the regulations to hand), then you are making the data available and Freedom of Information Act etc. requests for data sets for free do not need to be complied with. Your FOI officer can probably advise you.
I do, however, remember something vaguely about a Gov't policy on 'making use of publicly-collected datasets' a year or so ago, but as no-one asked for any data quoting it, I don't remember the details.

Subject: Network Rail Data Request
Hello everyone,
I've just received a request from Network Rail for data and location maps for all listed and locally listed buildings, SAMs, Conservation Areas etc etc on or within 20m of their land and railway lines. They have added at the end of their email that they will not pay for the data.
I just wondered if anyone else had received a similar request and how you are going to respond to it?
