SPOTLIGHT: A DAY FOR DECISIONS
U.S. District Court Judge Roger Vinson today is expected to issue his
ruling on the multistate lawsuit against the federal health reform law,
according to an aide to the Florida-based judge. The lawsuit was filed
by former Florida Attorney General Bill McCollum (R) last March with the
support of 19 other mostly Republican state attorneys general and
governors and the National Federation of Independent Business. Last
week, Vinson approved a request for six more states to join the lawsuit.
The suit argues that the law's insurance mandate is unconstitutional and
that the costs of the Medicaid expansion in the overhaul will overwhelm
states. In October 2010, Vinson denied the federal government's motion
to dismiss the lawsuit. Based on his comments during oral arguments last
month, Vinson is expected to be the second federal judge to declare the
mandate unconstitutional, but likely will not order an injunction
against the entire law.
