What the HR person is trying to do is cover her back in case he has some
form of "disorder" which means that he wasnt in sound mind therefore
cannot be taken to task over absence. Incredibly naive if I may say so.
The reason he didnt attend work was because he was banged up not sick.
He may not have been able to tell the employer this because he may not
have had access to a phone, indeed he may have wanted to keep it quiet.
The reason that the court want a psychiatric report is for sentencing
purposes, this should have nowt to do with his employment. The offence
must be potentially serious as he is on remand, however he is innocent
until proven guilty. The HR person should have a policy for dealing with
such issues - suggest that he needs to be suspended pending sentencing
and not have the buck passed to OH. Also - where is this info coming
from or is it all someone told bert who in turn told Bill....I think HR
need to get a definitive handle on whats going on
This is not an OH issue at all - but in addition, you cant get consent,
I take it you wont be going to visit him in jail? the psychiatrist will
be provided by the court so you dont know who to get the report from,
the GP will know about as much as you do so no point going there,
Have nothing to do with it

i am an o.h.a. working in food manufacturing. please what are your
thoughts on this situation.
i have an employee who has failed to show up for work and failed to
produce a fit note.
1. That,s h.r.problem not mine. h.r. has found out that this guy is in
prison on remand for a domestic incident.
was in court this week but judge wants psychiatric reports before
sentencing.
H.R. manager wants me to gain consent to obtain a medical report(why?
what grounds?) and she wants to see the contents before she disciplines
the guy for non attendance at work.
I have given her a short letter explaining that there is nothing in his
file to suggest that he has anything wrong with his health and therefor
would not be covered under the D.D.A.
1. THIS IS NOT MEDICAL.
2. INFORMED CONSENT? I,ve said that I do not know whether this guy could
give informed consent until we know either way after he,s seen the
psychiatrist.
3.I,ve said that I was,nt prepared to give them a consent form with my
name on it because i feel that if that,s the road they want to go down
then that,s up to them without my involvement.
