Another way to limit any negative impact publishing the images might have
on someone featuring in them is to appeal to the public for help with
identification. Some people might want to be indentified and might want to
come and give you some narrative to the image thus enriching the data.
That way you're stating that you don't know who these people are but you
would like to. It's not a get out of jail free card but people will
respect it.

It would also be worth considering the context of the photographs and if
they are likely to cause offence/upset/distress to the subjects. (e.g.
taking part in a demonstration in the 1980's which they would now rather
not be reminded of)
You also need to be cautious of inadvertently making the people depicted
identifiable - either with information on your own site or by somebody
doing a bit of simple digging around on the web and 'joining the dots'
As John has said, the risks are probably low, but it is as well to be
aware of them.

I would go for a risk analysis on the photographs.
Chances of the person in the photograph seeing the images Chances of the
person in the photograph not being happy with the image being publish
Chances of the person in the photograph contacting the gallery to let you
know they're unhappy Chances of the whole situation getting legal when its
just an image of a person (more than likely to just ask you to take it
down) Chances that publishing them with damage institutions reputation
Against the benefits of publishing them.
You've secured the most important rights so I would say that although
you're still not legally suppose to the risk is low to publish them.

Please can anyone advise on a copyright / data protection question we have
We have copyright permission from the photographer and the newspaper
concerned to publish some photographs that were taken for use in our
local newspaper but what I am worried about is the data protection side
of putting online photos of people who are still alive - the photos vary
in date from 1930s to last year.
So can anyone advise me whether we can put them online or not since we
don't ourselves have signed permissions from the people who feature in
the photographs that we can put them on the web.
