However, I did mean communicate as opposed to connect. It’s more of a legal issue/interpretation than anything else, but any approval under section 106 WIA 1991 relates to the communication of flows with the public sewerage system in addition to just the consideration of the mode connection. For example, if this was not the case, if a housing development was to discharge to the public sewer via a private sewer there would be no physical connection and therefore you could argue that approval under section 106 is not required. We would therefore have no control over the communication which would leave us in a difficult position. This was one of the points discussed during the House of Lords case.
