You may have already considered this one. I was wondering if OH work would
be considered a regulated activity and so require ISA registration,
particularly as from November it becomes a criminal offence to employ
someone who should be registered and is not (for which prison is apparently
an option).
My issue was whether the people we see are 'vulnerable adults'. The
guidance suggests that people with a disability are vulnerable. Given that
the only frame of reference I have to define disability is the DDA then we
potentially that's quite a lot of people. The guidance asks about as many
questions as it answers so I thought it better just to ask, and got this
clear reply, which I hope will be of some use
"The Home Office have asked me to reply to your query about the Vetting and
Barring Scheme and how it relates to Occupational Health services.
Anyone engaged in an OHS who provides health care of any description will
be dealing with vulnerable adults (as defined by the scheme). Staff who
provide assistance, advice or guidance, or any form of treatment or therapy
frequently to vulnerable adults will be engaged in regulated activity and
will have to be ISA registered. In this context, frequently means once a
month or more.
In plain English,this boils down to meaning that nurses in OHS services
will need to be ISA registered."
