There is a suspected leaky tank in the garden of a private house, but the leak
is affecting flats adjacent (where there are strong odours reported inside the
flats, where young children are living). The occupant of the house is denying
liability for the leak and the freeholder of the flats is arguing that they do not
have any responsibility to address the problems and that it is up to the
leaseholders. As leaseholders, their insurance is limited to their contents.
Any views on how to pursue this?
If possible, would like to avoid the complex Part IIA route!
