Abstract :
The talk will provide one contractor’s real life
experiences of how inadequate attention to
geotechnical detail can lead to substantial
losses. Areas covered will include the
consequences of: inadequate site investigations;
the late provision of information; the
misinterpretation of site investigation including
unanticipated heave problems; the effects of poor
communication within an organisation and the
disproportionate cost of rectifying problems when
litigation ensues. The talk will then show how
risk fits in with the three fundamentals of time,
cost and quality. The talk will then set out how
the various standard forms of construction
contracts deal with risk allocation and risk
management including those drafted by NEC, JCT and ICE.

Speakers' Biography :
Mr John Patch is a Director of Roger Bullivant
Ltd. He is a degree-qualified Civil Engineer with
38 years experience, 31 of them involving Ground
Engineering. The last 26 years have been spent
with Roger Bullivant, 22 of them as a Director.
He is a past Chairman of the FPS (Federation of
Piling Specialists) and of ASUC (the Association
of Specialist Underpinning Contractors).
Mr Wayne Lord is a Barrister and a Lecturer in
Construction Law at Loughborough University.
Wayne graduated from Loughborough University in
the early 80's with an honours degree in Civil
Engineering. Wayne went on to practise as a civil
and structural engineer with the likes of
Fairhurst, Derbyshire County Council, Faber
Maunsell and Atkins becoming a chartered member
of the ICE and IStructE in 1995 and 1997
respectively. In 1995, Wayne went off to
Nottingham Law School being called to the Bar in
1999. Practised law advising various construction
clients on a variety of different matters
included procurement and disputes for Eversheds
and a regional law firm for over 7 years before
entering academia in 2007. Wayne is now
responsible for researching and teaching
construction law to built environment
undergraduates within the Civil and Building
Engineering Department at Loughborough
University. He is also a past Chairman of
Construction Industry Council East Midlands.
