Subject: Re: Role of Access Officer as Part of Council Organisation
Hi
The Council has no powers over a non council service provider unless
they are subject to statutory control functions operated by the Council.
The Council may have liabilities if they have not applied the controls
effectively.
Otherwise the complainant should address the service provider directly
in the context of DDA or other similar legislation.
The Access Officer, dependent on role and location might offer technical
guidance and moral support.
The local Access Group might be notified to widen the number of
complaints.
However a Local Authority has the interests of residents at heart and it
might be appropriate to lobby on their behalf.
In a previous life, as an Access officer I often took up the complaints
of the public in relation to major service providers such as transport
operators or supermarkets.

Subject: Role of Access Officer as Part of Council Organisation
Hi Everybody
My name is michael zuliani, I'm a chartered building control surveyor
working for Cherwell council.(I have also recently commenced a MSc in
access and inclusive design at Salford University). Following the recent
retirement of our access officer the responsibilities relating to access
were 'parked' with building control (hence the opportunity to pursue the
Msc) One area I'm unsure about (one of many) relates to the following;
If a member of the public contacts the Local Authority with a complaint
regarding access issues relating to a privately owned building (within
the district), what powers (if any) does the Council have or is it a
matter of informing the complainant that they should pursue the
complaint individually through the framework of the DDA against the
owner/operator of the building.
Grateful for any help offered
Michael
