It has been nearly a decade since I worked in Massachusetts on both sides of the regulator/consultant fence, but as things were then it was the individual who was licensed. An LSP would then work for a consultancy that would provide them with cover through internal agreements/contracts. Some LSPs would carry separate insurance as although they may be covered by their company's insurance they could still be fired as a result. It was also not uncommon for licenses to be suspended or revoked if misconduct was encountered.
This article states that there was a mixed record in Mass, but having worked within the system I can say that it was largely successful. It is my home state so I may be a bit biased. Things are quite different there as there is not the ambiguity with clean-up values etc. Most efforts are therefore concentrated on making sure that a site is properly investigated, modelled, risk assessed and inevitably remediated. Remediation (not the dig-and-dump variety) is widely practiced. It is these elements that the LSP oversees and validates.

Is it the case that individuals are licensed and then carry their own
indemnity insurance or are employers licensed and liable; or are
individuals licensed and employers liable? Can you see where I'm
going here?
