Firstly, I think its important to note that its status as "inert" is pretty much hearsay until either they prove otherwise or records exist to substantiate this. Secondly, dependant on when and by who it was infilled, "inert" landfills even when licensed were tipped with pretty much anything. I was out on site once spiking a landfill that had been restored for sometime (I know! we don't do this anymore) when we enquired with the owner and former operator why we were getting 50% CH4 in a large part of the site that was supposed to have been infilled with demo rubble...he attributed it to a donkey that was buried in the area some time ago! Now it may be that this donkey was the size of tennis court but I think its more likely that a considerable amount of non inert waste was tipped.
For me, if it was one dwelling I would advise them to either carry out monitoring from boreholes at the interface between the development and landfill or install gas protection measures within the property i.e. independently validated gas membrane and sub floor void.

Hi all,
I have a site that has come through the planning process where the applicant
wants to build a new property approx 100m from an infilled chalk pit. The
applicant states the pit was infilled with inert clay material, however we have
no way of knowing this for sure.
In order to give us more weight in our argument I was just wondering if anyone
has any examples of where someone has said a pit or quarry has been infilled
with apparently inert material only for a site investigation to show that it is
giving off elevated gas concentrations?
I have a feeling there was a part IIA site from a couple of years ago where
there was a similar situation??
