Dear all,
If you come across patients being denied treatment because of their
immigration status, please consider getting in touch with Adam at
Pierce Glynn Solicitors. It is hugely important that he knows what is
happening on the ground to enable him to mount a legal challenge
against the charging regulations.
Many thanks,
tom

Subject: Help needed - test case on access to healthcare for refused
asylum seekers
As you may know the Court of Appeal recently decided that refused
asylum seekers should be charged for NHS treatment, but that treatment
should not necessarily be withheld if a patient cannot pay for it and
cannot return home immediately. Many people are concerned that the
effect of this will be that treatment is denied, because of
misunderstandings as to when people can or cannot return home, or
because people are deterred from seeking it.
We are still considering whether to appeal to the House of Lords, but
in order to do so we need evidence to show that this isnt merely a
debt issue, but a question of whether people get treatment or not, so
we need to know what is happening on the ground following the
judgment. So please can you e-mail me whenever you come across any
reports of people being denied medical treatment, or failing to access
treatment, as a result of the charging provisions. The e-mail can be
as short or as long as you like, with as many details as possible, but
the important thing is to let me know, otherwise a further appeal will
not be possible. Please feel free to forward this message if
appropriate.
Many thanks,
Adam Hundt
