We do the same and the student would not have a case. We state on our
website as it helps to point to a statement clearly available:
"Courtesy Notices
The email service to remind readers that they have items about to become
overdue is a courtesy service only. It is the reader's responsibility to
ensure that loans are renewed or returned on time. Due dates are shown on the
receipts when items are first issued, and this information can be seen
through the 'my library account' section on the Library catalogue. Readers
can also contact the Library by phone during Library staffed hours. "

Total agreement. We send out overdues (or underdues) in an effort to get
our books back, not to benefit the users. And besides, the 'contract' is
that the student will return the book, not that we will remind them to
return the book.
Your student has no case. It's as simple as that.

Completely agree with Paul. In fact we have written into our library
regulations the fact that courtesy notices are just that and that
failure to
receive them will not invalidate any subsequent proceedings or action.

There is absolutely no way I reimburse in this case. Courtesy notices
are just that - a courtesy. Our policy is exactly the same as yours - it
is the responsibility of the borrower to ensure that books are returned
on time, that's why we have date stamps and students are able to check
their accounts online. I'd stand firm on this one

Just a quick question to everyone to get a feel for what goes on
elsewhere...
We recently experienced a problem with our email 'underdue' reminders to
students (emails sent when a book is due the next day). The reminders
were
sent from our systems, but our email server failed to deliver them for
about a
week.
As a gesture of goodwill, we've halved the fine for any students who
failed to
renew their loans and accrued fines because of this, but we also have
one
student who is determined that this is not good enough, and wants all
students fully reimbursed. I've explained that underdues are a courtesy
service
and it is the responsibility of the borrower to ensure that loans are
returned or
renewed on time regardless of them, but he does not agree and is
determined
to take things further.
So, I just wondered what the policies of other libraries are? Would you
reimburse or not?
