I think the main issue is that taylor wimpy didn't register the shaft
until 2007 7 years after he bought the house
I agree though it the NHBC are saying its fine I don't see why a
mortgage lender would refuse a loan
Though I can see why it would put off potential buyers. Though this may
be due to his poor communication. Telling someone there is a mine shaft
in you front garden is one thing telling them that it has been correctly
filled and capped and that this has been confirmed by the NHBC is
another

If the shaft has been treated properly then I cannot see why this
constitutes an issue to the lenders. Yes, developer should possibly
have informed purchaser, but then so should his Lawyer at the time of
purchase, if they were at all switched on. Unfortunately for the
homeowner I think the amended Law Society due diligence guidance came in
around Oct 2006.
Plenty sites with treated (and untreated !!) mineshafts on them.
