Several years ago a friend who lived in Wigan had his house for sale. A
prospective buyer had his mortgage refused because - "...we do not
provide mortgages in areas of mining subsidence.." from a high street
bank.

Workings were deep and 80+ years old, no faults etc to cause problems
and no subsidence claims in the vicinity for years. It was very close to
the main west coast railway line which had no substantive subsidence
despite regular precision survey for I think 30+ years. There was a
small crack caused by a minor structural flaw. I wrote a mining report.

Still no joy with the mortgage provider.   I phoned the bank's mortgage
manager who was based in Bristol. After he agreed that was their
office's policy I asked him if he lived in Bristol, which he did. I then
asked him if he was aware of the Bristol Coalfield, which he wasn't - I
then asked where in Bristol he lived ...flustered refusal to tell me -
followed by a silence  - followed quickly by a sudden change in
policy..!! 

Unfortunately it was too late for my friends sale - the prospective
purchaser, not surprisingly, got cold feet, but the property was happily
sold a month later and the mortgage was happily provided by - you've
guessed - the same high street bank.

I think the main issue is that taylor wimpy didn't register the shaft
until 2007 7 years after he bought the house 

I agree though it the NHBC are saying its fine I don't see why a
mortgage lender would refuse a loan

Though I can see why it would put off potential buyers.  Though this may
be due to his poor communication.  Telling someone there is a mine shaft
in you front garden is one thing telling them that it has been correctly
filled and capped and that this has been confirmed by the NHBC is
another

If the shaft has been treated properly then I cannot see why this
constitutes an issue to the lenders.  Yes, developer should possibly
have informed purchaser, but then so should his Lawyer at the time of
purchase, if they were at all switched on. Unfortunately for the
homeowner I think the amended Law Society due diligence guidance came in
around Oct 2006.

Plenty sites with treated (and untreated !!) mineshafts on them.
