I like the exclusive definition of artistic works - eg: film, recordings, I
assume code, cannot be art.

This ACLS session you attended Tim seems to have been uncannily synchronised
with last week's launch by the Joint Working Party of the British Academy
and the Publishers Association on copyright in the humanities and social
sciences of its Joint Guidelines on Copyright and Academic Research

The BA plans to develop the guidelines to cover other copyright works such
as artistic and musical works "in order to provide continuing support and
protection of the interests of both academics and publishers".
 
The "fair dealing" section does the usual legal wriggle round Benjamin's
aura ("Notice that the exception does NOT apply to the copyright in films,
sound recordings, broadcasts or typographical arrangements, but ONLY to
literary, dramatic, musical and artistic works"), and overall the paper's
foreseeably quaint with hopes to "have considerable moral force in the event
of dispute" - quote from John Kay, Joint Working Party Chair, whose
presentation of his feat begins by saying that "Publication is central to
research, but publication is necessarily a commercial activity" - as befits
the economist and business writer he is. OHP is clearly from/ on / about
another planet.

I also heard numerous remarks that assumed that electronic publishing
would necessarily be counter to the notion of "peer review" itself,
something on which academic institutions rely for promotion, etct.
Although the sciences seem to have figured out how to balance open
source archives with later peer reviewed publication, the humanities
haven't yet gotten there.  This could be related as well to a wide
anxiety over the possibility of the disappearance of the published
book.

What rarely seems to figure in these discussions is the potential of
the kinds of multimedia texts and experimental forms of writing that
have fueled Simon's practice for years.
