Well said L Kenyon!!! Just like we did pre-dda. Best practice is best practice! Don't get bogged down....do the right thing & -begin with the end in mind - you will hold your head high in any ET & defend your actions/advice.

You should ALWAYS assume that the DDA applies; and consider whether there are any adjustments that would enable the person to carry out the job to a satisfactory standard.  Obviously, if there are impacts for customer and/or output where someone is not available during certain times, then redeployment (if available) might be the only adjustment worth considering.
   
  Adjustments, once identified, might then be practicable - or not.  The question of practicability, not whether colitis is covered by the DDA, is the question; as Shakespeare might have said...

I have a member of staff who says she has 'colitis' and that it would be covered by the DDA though at no time does she refer to it as Ulcerative Colitis. Her treatment seems to consist of Imodium and coming into work late every morning to allow her time to go to the toilet!  She says her work is stressful which has an impact on her 'colitis' so in her opinion it is a work issue.  She feels that because she is on medication this means she is covered by the DDA.  
Has anyone any thoughts re the DDA applying.  I know the ET will make a final judgement but I dont know whether I should class colitis as falling under the DDA.

  Hello everyone
 
One of our employees has put a suggestion in the works suggestion box that our site goes completely smoke free - banning anyone from smoking outside on the premises.  At present employees are allowed to take smoking breaks when they wish and smoke in designated places outside the building.  The employee who suggested it is actually a smoker who wants to give up and says it would help him if it became harder to smoke while at work.  Management are interested and want to explore this further.  I know that some hospitals have gone completely smoke free and was wondering if any private companies have also followed this policy.  If so, what problems were encountered and how were they resolved? My personal feeling is that we take one step at a time and as our on-site shop is still allowed to sell cigarettes, to start with banning the sale of them and then go from there.  I do provide support for smokers who want to give up both in groups and individually.
