Hi
As a contractor/freelance OHN I have to be VERY careful not to be deemed a
worker as such and therefore do not need to comply with the WTD that a
company applies to its workers as I could then be pounced on by HRMC.
Its hard work trying to maintain ones identity as a non employee/worker
and I do have to work at trying to maintain a professional distance from
the companies I sub contract to.
As far as I am aware, as we are not employees, we have no recourse to
ET's but would have to go through the courts for breach of contract and
that sort of contract appraoch. If we decide to change horses to suit an
agenda then we could find our selves parting up to £800 a month back taxs
under IR38 (never by the way trust any number I give you!! as am
dyscalculate)
