Dr.Bill Gunnyeon who was the President of Fac.Occ.Medicine in 2004 made some useful observations
In his statement he commented:-
"The advice contained within an FMed3 is advice from the GP to the patient (the employee)
not the employer. The employer is of course,not bound to accept it if he can demonstrate
that he has based any decision he makes on informed advice that is at least of equivalent competence".
Furthermore "The FMed3 is issued as a statutory requirement for the purpose of access to State benefits-
not for the purposes of assisting employers to manage their attendance issues."

Morning all
Would anyone have a statement or reference to hand for the legal purpose of
the Med3 that i can include in a document for one of the HR teams i'm
liaising with at the moment?
I've got the DWP document from the archives (DWP 2004: Medical Evidence for
Statutory Sick Pay, Statutory Maternity Pay and Social Security Incapacity
Benefit purposes) but am looking for a nice statement about it - i used to
lift one from an article in OH years ago but can't find my hardcopy of the
article.
Any help gratefully received as always
