Thanks very much to the colleagues who have kindly shared their experiences
and advice with me today. I have had several phone calls and emails, which
makes me think this is another issue for general discussion, as regards
copyright.
The general guidance seems to be:
- Seek permission from editors and newspapers direct, before copying - some
people have express permission from papers to create bulletins, etc. and
many of these have been given free of charge (stick strictly to the terms of
any such agreement).
- Where no permission is granted or has been sought, general rule is to
advise users NOT to copy from newspapers, full stop.
- Some organisations have a newspaper copying licence - check to see what
the terms are, if you do find your organisation has one.
- Some newspapers are now online. Check the terms on the site before
downloading material.
- The NLA are very keen to pursue organisations who have no licence and are
copying from newspapers, so it is best to ensure NO copying is done, rather
than risk a breach.
It is unclear what the terms of 'fair dealing' would cover in a newspaper
article- for a short article 5% would be very little information - again,
best NOT to do it.
Hope this clarifies things a little, but it is an area that perhaps we
should be considering as part of the copyright issue as a whole (?)
