I am not sure those, like us, who followed guidance from the act and other
sources, and did not give in to CLA threats, were not breaking the law. Only
the CLA said we were. Not sure the CLA even prosecuted anyone as I think
they would have been found wanting.

Yes, very messy. Tough on those who resisted breaking copyright law &
refused to do copies for their users, only to find that they would have been
covered anyway!
(presumably making it retrospective means that those who did break the law
have now been 'pardoned'. If anybody had been fined would they get the fine
refunded?)

Yes, messy indeed! Does anyone else find it ironic that librarians have to
rely on information from our "enemies" the CLA, rather than from the NLH,

Dear Christine
The copyright deal has been backdated to cover last year - I suspect to
cover those poor souls who infringed copyright law during that period.
They are refunding all the trusts who paid for their own licenses during
that period too. Its all been a bit messy really hasn't it!

Can someone tell me, please, why this is "With effect from 1 April
2006"? Since the terms of the licence have only just been agreed and
today is the first time we've actually seen a printed version of it, how
could we have been using it for over a year?
My understanding is that if we'd been making copies in the last 12
months in the way that we are now allowed to, we would have been in
breach of copyright law and liable to a hefty fine.

I apologise for the delay in getting this to you but the materials took
longer than expected to complete.
If you are familiar with the terms of the old licence then you will see
that there is no change in the terms and that the same things can be
copied. The news is that we have now agreed to renew the central licence
rather than issue separate licences to individual trusts.
Attached are revised User Guidelines (intended for those making
copies)
and Explanatory Notes (for the licence administrator) about the new CLA
licence for NHS England.
