The answer is variable to the medical condition and the job and the
employers policys...
EXAMPLE 1
If someone is genuinely off sick and they happen to have annual leave
many employers allow them to take those days back later.
eg - a/l booked but gets chicken pox, they off work at home with med 3
for 2weeks. Generally the a/l turns to sick leave and a/l can be
claimed later. In just the same way as accruing a/l while on maternity
leave.
EXAMPLE 2
However if someone is going abroad/away from home etc and this is
incompatible with the symptoms why the GP gave a med 3 - then the GP
would be being very reasonable....
.. eg - Job is a receptoinist, off with bad back but going for a one
week holiday cycling in france or italy... Clearly inconsistently
unwell!
EXAMPLE 3
Job requires a very high level of physical fitness and although well
enough for usual ADL's, off sick from work... one could argue a week
of sedentary holiday would be reasonable. Some patients may be off
sick due to public health risk of infection but a/l where not exposed
to general public or children may again be reasonable...
