In response to Roger, I would say that I have received a different view
from the office of the information commissioner to the effect that
historic environment information is subject to the EI Regs 2004. If EH
is aware of more recent or explicit views from the Info Commissioner,
then EH should communicate this to the wider archaeological community.
If HER information is used in respect of planning applications or EIAs
where such information is "in the main" considered to be 'environmental
information', then how is it not environmental information under other
circumstances? What is the rationale for this view? Can someone at EH
please gives us a legal response on this matter?
This is especially important because the real issue here is that if
somebody asks for HER information quoting the FOI or EIR, then we have
to provide this under the terms of the FOI Act or EI Regs, which means
free (or at least free for most normal enquiries)! So much for
charging.
