Has anyone identified an appropriate person after the determination and
designation (as special site) process?
We are in the process of designating our acid tar lagoon site (it was
officially determined in end of October this year) and have had queries
from the E.A. as to whether the previous owner (now deceased) could be
classed as an appropriate person in order for her estate to be available
for remediation costs. The site was not sold on before the death, there’s
no next of kin and the site is now unregistered. We have our legal team
looking into this.
But while our legal team are looking for an answer with the above, I would
like to get on with the designation process? I would be grateful to hear
from anyone who knows if an appropriate person can be added at this later
date or anyone who has had experience in adding an appropriate person, and
what, if any, problems it may cause.
