Hello listmates,
I am trying to collect information for a disability activist colleague of
mine in Hungary.
Here's the question he is trying to get answered:
Apparently in Hungary, people with intellectual disabilities who are deemed
to not have "full legal capacity" (I'm not clear on what the criteria are in
Hungary to make such determinations) have a great deal of difficulty getting
any form of employment. One of the reasons for this is that the person
deemed to not be legally competent is prohibited from signing any employment
contracts. Employers are reportedly unwilling to accept an alternate job
contract that is signed by a guardian because the guardian cannot be held
responsible and is apparently not considered legally accountable for
workplace incidents (injury, incidental damages, etc.) involving the person
with the disability. Reportedly, the result is that many employers in
Hungary feel they cannot hire people who have guardians because the
individual him or herself is not legally bound to any contract he or she
signs, and the guardian's endorsement of an alternate contract is not
practically meaningful.
My colleague wants to know how such situations are handled in other
countries. Do any of you know how people with legal guardians navigate
employment contracts in your country? I would appreciate any insights
anyone has, and I will pass them on to Budapest.
