I presume that comments are being sought on this document?
Based on a quick read, I think it would be helpful if the there was a more thorough and explicit model of the relationships of the proposed 'elements' to the described resource. For example, it seems to me that the relationship between the value of Category.Title and the described resource is different than the relationship between the value of Contribution.Contributor.Email and the described resource. And both of these are different than the relationship between the value of InstantiationCategory.Identifier.Type and the described resource. The first is a property (to use a semantic Web term) of the described resource, the second and third are properties of other things.
As with LOM, these relationships are implicit (to a human reader) based on the name of the element and its position in the hierarchy of 'elements' and 'containers' but this is not made explicit anywhere as far as I can see - perhaps the underlying model for these relationships is made clear in another document? Simply refering to all these entities as ISO 11179 'data element concepts' and 'conceptual domains' is not sufficient to specify their relationship to the described resource and other resources.
In passing, I note that the term 'element' is not actually defined anywhere in this document - again, I presume it is defined elsewhere.
To make matters worse, allowing the semantics of the top level elements/containers to change depending on whether their child 'elements' are populated or not seems to be a recipe for confusion rather than for clarification and simplification.
