Dear Rebecca,
Why does the company want to challenge the sick note ? If the employees
perception is that they are stressed then what should be happening is
the company should be exploring the underlying reasons that have led to
this conclusion and then working with the employee to seek to a
resolution to the issues raised as is required by the HSE standards Nov
2005; they are not going to get back to work without the situation being
addressed and resolved. With regard to the HSE this is not reportable
however a return to the working environment without any
changes/discussion/ would put the company at risk of breach of duty of
care ( Walker v Northumberland) as it is reasonably foreseeable that his
health might deteriorate with out action/intervention.
With regard to the employee refusing to liaise with the company I would
leave this to HR, they should be applying policies/procedures to
facilitate contact, the only role OH could have in this is in my opinion
one that might facilitate mediation.

Subject: [OCC-HEALTH] Occupational Stress
Morning All,
I wonder if someone can give me some advice regarding the reporting of
Occupational Stress and to whom.
If a GP writes Occupational Stress on a sicknote, how as a company can
we challenge that in fact it is caused by work, and secondly does it
need to be reported to the HSE? A friend has recommended speaking to the
Safety personnel onsite, but they are unsure of what to do also.
I may be asking a really obvious question, but want to ensure I am doing
the right thing.
I have an employee currently signed off with Occupational Stress by his
GP, I have obtained consent for a GP report but this employee refuses to
have any further contact with anyone from the company, so not sure how
best to help him.
Any advice would be gratefully accepted.
