Isn't it usual for negotiators to try to foresee the consequences of failure *before* they start negotiations?

You are quite right. We should all send comments to NLH ([log in to unmask]) as requested. However that is very different to emailing, "directly to Ben Toth", or perhaps I misunderstood the meaning of the orginal posting that I responded to (entirely likely as it is Friday afternoon after all....).

I received the following:
"Ben Toth, Director of the National Knowledge Service, has been negotiating
with the Copyright Licensing Agency regarding the NHS Copyright License.

So I have sent my comments to NLH ([log in to unmask]) as requested. If
we do not alert those who are undertaking the negotiations to the
implications of the loss of the licence, they will be negotiating on our
behalf from a position of ignorance.
However, I am not advocating that we all bombard them with copies of other
people's emails, simply that we point out the impact this is likely to have
on our service, our users and patients.

Given that none of us know exactly what happened in the course of
negotiations between the NHS and the CLA (and presumably a lot of it is
confidential) I don't really see any benefit in bombarding Ben Toth with
emails. I would imagine that he and his colleagues are already very
aware of the concerns raised by members of this list and others.
Any kind of high level negotiation is extremely complicated. If Ben is
still talking to the CLA on behalf of NHS librarians I would imagine
that the last thing he needs is a mailbox full of emails like this one
to distract him, so I'll not be ccing this to him as suggested.
Personally I feel that the NLH team and colleagues have reacted with
admirable speed considering that the breakdown in negotiations may have
been as much a surprise to them as to the rest of us. If it is a
funding issue, it's hardly their fault that the NHS is going through
some difficult times at the moment.

My apologies for bringing up the whole CLA licence thing again,
but I'm unsure how this applies to the core content resources. Are we
allowed to print the articles for our users (some GP surgeries still
don't have easy access to Internet-capable PCs) and post them on? I

because it's changing the original format the article is available in
(i.e. the reverse of scanning and e-mailing a printed article). Do we
still have to adhere to the rules of fair dealing if acquiring core
content articles on behalf of users (i.e. only provide one article per
issue and only after receiving a signed declaration form)?
Any clarification would be most appreciated.
