Perhaps staff might be eligible for legal aid - we are not highly paid after
all (calculator for legal aid is here, but it is pretty stringent

librarians of the NHS and beyond might consider helping with
expenses/freedom campaigns...........

The CLA seem to be getting more & more desperate & bullying in their
arguments & would seem to be seeking to overturn years of custom & practice
by declaring it wrong. Their arguments & 'information' (actually opinion)
presented in the FAQs don't answer the questions. For example, they don't
define 'Fair' - just say what it isn't.

If their definition of 'research' was applied it would prohibit most
photocopying carried out by individuals in most libraries - it implies, for
example, that if you photocopy the results of a 'Which' test on toasters you
are not carrying out research.  "Furthermore, CLA believes that the law
requires that the research purposes be your own, not those of or for your
employer" - this clearly wipes out all (or 99.9999999%) of the photocopying
carried out in NHS libraries. However. they say that 'Private study' "must
be study for personal/private use and not, for example, study in the course
of employment or study which assists in the development of a career."  This
means that I could photocopy material from my library on Michaelangelo if I
am pursuing a structured investigation into his methods of fresco painting
(ie "a diligent and systematic pursuit of the study of principles or
facts"), but not if I just had a general interest in his work. I would not
be able to make photocopies of journal articles on management if I was
studying for an MBA, as this would clearly be aimed at career development. I
couldn't make a copy of an article on introducing a new enquirey service in
a health library, as that (a) wouldn't be part of a "diligent & sytematic
etc" and (b) would be research for my employer.

It shouldn't be forgotten that they are simply giving their own
interpretation of the law. Others can interpret it differently. The
definitive interpretation results from a court case where the two
interpretations can be argued & a judge decide in favour of one or the
other.

Previous discussion seems to assume that (reasonably) innocent librarians
will be able to grass on copyright infringing Trusts. The trouble is that
librarians ain't that squeaky clean, if you look at the CLA site.

(I hope I've typed these correctly). I rather assumed that we went back to
roughly the pre-licence days, but it appears not.
