I make sending this request for information tentatively, as I am
conscious I may be missing something blindingly obvious and am about to
expose my ignorance to the health library world ...
With apologies for raising copyright again, but I wanted to seek advice
on a point made in Maureen Duffy's recent email regarding Table of
Content services. Maureen noted that ' if six people request the same
article (not an unusual occurrence, especially from the better-known
journals, or on a hot topic), we can apparently only satisfy the first
request'. I've had a quick glance at the legislation, which states,
with regard to librarians interpreting the requirements of people
requesting a copy of the same article
(a) that requirements shall be regarded as similar if the requirements
are for copies of substantially the same material at substantially the
same time and for substantially the same purpose; and
(b) that requirements of persons shall be regarded as related if those
persons receive instruction to which the material is relevant at the
same time and place.
What I need advice/clarification on is interpreting part b. Does a
Table of Contents constitute 'instruction to which the material is
relevant'? It obviously promotes/raises awareness, and is received by
many people at the same time, but does this mean the 'requirements of
persons (are) related' if they request an article from a contents list
for entirely different purposes? I realise this is very pedantic, but
the ongoing copyright situation has strengthened my natural pedant
tendancies! I would be grateful for any advice/comment. Also, until
May we ran a TOC alerting service based on our own journal subcriptions
as the only way to promote our holdings to our users (all of whom are
off-site). Does/did anyone else offer such a service?

I would endorse everything in Tricia Rey's reply. An additional
problem
arises from the distribution of etocs - if six people request the same
article (not an unusual occurrence, especially from the better-known
journals, or on a hot topic), we can apparently only satisfy the first
request, leaving some users disgruntled & possibly short of essential
information.
I am thinking about electronic signatures on copyright declarations,
but
that's another minefield!

Dear colleagues
I am aware of concern within the health library community about the
non-
renewal of the CLA licence for NHS England. Guidance for librarians has
been
provided at http://www.library.nhs.uk/forlibrarians/copyright. The lack
of
an NHS licence across England is likely to create more administration
and
uncertainty for all NHS staff. I would imagine that the areas of impact
are
likely to be in preventing:
o Copying of multiple copies of copyright materials for continuing
professional development sessions, journal clubs etc.
o Copying of multiple copies of copyright materials for corporate
meetings etc
If significant numbers of NHS organisations within England do decide to
take
out licences it could even cost NHS England more. As the Health
libraries
representative on LACA
(http://www.cilip.org.uk/professionalguidance/copyright) I would be
interested in knowing whether you are experiencing problems as a result
of
this difficult decision in balancing the NHS'allocation of resources. I
will
then feed back to LACA and summarise for this list, anonymising
replies.
