Hello Jane,
You are correct that under the ERA it is now acceptable to transmit off-air
recordings made under ERA licence through an internal network of some sort
(VLE, WebCT etc), but only if this cannot be accessed outside of the
institution, even by registered students or staff. Please note that the ERA
licence does not extend to radio or TV programmes available On Demand, but
only to those recorded 'live' when broadcast.
Under no circumstances is it acceptable to network a commercial release
this would constitute copyright infringement.
Sections 32, 34 and 35 of the Copyright, Designs and Patents Act 1988
doesnąt distinguish between TV programmes or feature films shown on
television and allows their use in education.
