Justin,
Sounds like that on certain peak trains what is needed is a specific bike
carriage for which there would be an additional charge for 'non-folding' bike
space. Then disabled person would pay same rate for bike and therefore no
discrimination occurs.

If we are promoting sustainable transport this seems like a "new service"
required on trains for which a charge may be necessary to all customers on peak
lines.

>Dear All
>
>My company has a ban on carrying bikes coming into London during the peak
times on our trains, unless they are the fold up type which can be stored as
luggage. This is because of the space they take up and the potential hazard
they are on busy trains. They also tend to get stored in the space reserved for
wheelchairs, there by making this space unavailable for wheelchair users.
>A passenger who has only got one arm, which is replaced by an artificial limb
comes through in the peak with his modified but non the less non fold up bike.
He claims that he has to secure his arm to the handle bars with a special
fixing which is not available to fit on the fold up bikes, there by he cannot
use one of those types of bikes. The opinions I seek are a) would this be
defined as a disability under the DDA i.e. having an artificial arm and b) if
it is could we be discriminating against him if he really cannot buy a fold up
bike that can accomodate his arm? Bearing in mind that this is not a mobility
aid as such and that on train service will be covered under DDA from Dec this
year.
