This seems to be a tricky one to me because a vehicle with a tail lift will
usually cost more to hire than one without. Am I correct in thinking that it
would be reasonable generally to offer the vehicle at a higher rate but be
prepared to make an adjustment in the rate (ie the same as a vehicle without
the tail lift) if a disabled person requires the tail lift to be able to use
the vehicle?. I can understand that it would be reasonable to provide blocks
on the foot pedals or provide a wide rear view mirror because this would
enable a person to drive the vehicle (whether it has a tail lift or not)but
how does this relate to the fact that the vehicle has a tail lift? In theory
anyone with a blue badge could hire the vehicle at a reduced rate to move
furniture for instance. If this were a public service vehicle then it would
obviously not be reasonable to charge more for the fare to ride in it just
because it has a tail lift but I don't see the relevance when the vehicle is
being hired out without a driver. I don't see the link between the vehicle
having a tail lift and the ability of a person being able to hire it... a
tail lift is obviously essential to allow some passengers to board the
vehicle but are passengers a consideration for a vehicle hire company? It is
the driver who usually has to sign the agreement.
Perhaps I can't see the wood for the trees..... any more advice would be
much appreciated.

Unfortunately Dave at present transport providers are exempt from the DDA
part 3 (DDA 1995 s 19 (5)(b)) - this exemption is removed in December this
year as part of the DDA 2005 - therefore, at present, as I understand the
situation they can charge extra if they so desire!
