I would always refer to the licence you have signed with the copyright
holder. The CLA site actually says that the HEI licence does not cover
material published electronically and that you should refer to the
copyright holder.
In terms of sending articles electronically, most of the licences we have
say that you can supply a single electronic copy for ILL only if you do so
using Ariel or another system which ensures the file is deleted immediately
after printing. There are some publishers, however, that don't allow this
and also some which expressly forbid any use of the electronic journal
(either printing or emailing the articles) for the fulfillment of ILL
requests. Some of the licences allow us to email copies of single articles
to an Authorised User but I can't see that this would apply to your "sister
library" scenario - if you were an Authorised User of the content then you
wouldn't need them to send it to you.
I'm inclined to take a cautious approach - if a licence does not say that
we can email articles or use them for ILL but it also doesn't say that we
can't, then I assume that we can't.
