Dear Colleagues,
first of all my excuses for duplicate postings, but I need to cover all
bases because of the urgency of the inquiry (the professor needs the
answers yesterday and I shall provide miracles...)
A professor of the law faculty needs the current version of the following
law code section (and of course also an english, french or german version
if available).
The mentioned law section should deal with the problem of wilful deceit in
contract law (in case the professor cited the wrong law code..)
I am looking for this section:
Art. 255 CC
I searched Westlaw.com, LexisNexis but found nothing.
==> I found http://www.lexportugal.com/lexportugal/ and
http://www.jurinfor.pt/Jurinfor/default.htm (both not for free...)
==> I found this Word-Document
http://www.verbojuridico.net/download/codcivil_2003.zip through
http://www.verbojuridico.net/ but it was last amended in 2003:
CÓDIGO CIVIL
Actualizado até ao Dec.-Lei n.º 38/2003 (Reforma da Acção Executiva)
ARTIGO 255 (Coacção moral)
1. Diz-se feita sob coacção moral a declaração negocial determinada pelo
receio de um mal de que o declarante foi ilicitamente ameaçado com o fim de
obter dele a declaração.
2. A ameaça tanto pode respeitar à pessoa como à honra ou fazenda do
declarante ou de terceiro.
3. Não constitui coacção a ameaça do exercício normal de um direito nem o
simples temor reverencial.
==> Is this the current version?
==> Is there an english, french or german translation available?
Thank you very much for your assistance.
Kind regards,
Gudrun Schwarz
