I would perhaps in this situation explain to the HR Manager that you had not
realised that the issue that he raised with you was confidential between him
and yourself and that this is perhaps something you ought to clarify on an
individual basis in future so that the problem wouldn't recur. 'However you
accept that on this occasion it may have caused difficulties for him/her and
for that you are sorry' or something along those lines.
I recommend to customers that this issue is dealt with in a sickness absence
policy as many do 'secondary work either paid or unpaid' within their own
time. If this is the case they are admitting that there are some duties for
which they are capable of and therefore we should be looking at some
rehabilitative work at work.
Some employers choose to go a step further and state that those receiving
payment for work whilst off sick are not entitled to company sick pay or SSP
as they are clearly fit for (some kind of) work.
Hard line from someone who has dealt with a number of 'game players' I
realise however something to be considered.

Hi Everyone,
I just had to write to say thank you to everyone who replied both on and off
list.
I certainly feel vindicated in my handling of the situation and have a much
better idea of how I plan to proceed.
I think the situation was made worse because the employee and his manager
both work in HR.
It is great to see the list being used in this way again - to support each
other.
