I have never had a consent refused. The discussions have at times been
'challenging' - I have never been hit yet but came close once!!. Clients
tend to be looking for a way out of the situation that they are in and we
discuss those ways forward. Either that or trying to play us - I enjoy
people trying to play me - its fun.
If my gut tells me that they are not happy bunnies, I get their consent to
write to their GP requesting a report and offering advising the GP on the
nature of the adaptations etc that we are offering.
You may have noted the patterned before - "I want to come back to work on
Monday but it depends what the GP says tomorrow" - this usually means I have
no intention of returning and I am going to play my GP tomorrow into getting
another GP note. I usually write at that point to 'support' them in their
return by providing the GP the whole picture ie. what rehab options are
available.
The reports therefore that they are consenting to will reflect the fact that
"we hope that they will be able to return to work on Monday and have written
to the GP to confirm the adaptations available to them". GPs can use the
report request, which encloses the rehab offer, to manage a patient that
they probably can see through as well as we can.
Don't forget however Helen that if you are offering information that is
already known e.g. from FMED3's you arent breaching confidentiality neither
is talking in general terms. "As you are aware, Mr Bloggs has been absent
from work due to sickness absence since 1.1.02 with an amputated brain. His
health problems are currently being managed his GP and Consultant
Specialist. There is little that we can offer at this stage that would
assist in his rehabilitation."
I get consent for requests where we need funding for specialist outside
agencies e.g. physio or CBT. They are happy to give this normally as it is
"sumart fo nowt"

Amanda, have you ever had a situation where the employee does not agree with
your recommendations and refused to sign consent to release the report. If
so, what do you do then?
I had always thought that signed consent was good practice, but that legally
we were able to issue advice on fitness for work and any reasonable
adaptations without signed consent, and that consent was only legally
required if we were releasing medical information in the report.

Hi Tina /all
I discuss the reason for referral with the client at the start of the
interview and go through what is written on the management referral form so
that I know that they know why they are there. I explain at this point that
at the end of the interview i will need to formulate a report for management
addressing the questions asked as part of the referral.
At the end of the interview I discuss with the client what I feel the
recommendations / advice to management should be and bullet point it is the
report. i then ask the client if they consider this reasonable. If so I ask
them to consent to the release of the report to the manager in question as
outlined in the bullet points within the notes and they sign the notes with
the consent statement. where they request a copy of the report, one is sent.
The bullet points also help in the dictation of the report - the dictation
tends to be less garbled!!
