I have been asked to find the current legislation in the UK for the retention limits for pupils with special education needs. There is the suggestion that new legislation stipulates time period of 34 years but I can't find anything to confirm this. The latest legislation I have found is a statutory instrument,
Statutory Instrument 2000 No. 297, The Education (Pupil Information) (England) Regulations 2000,
but this does not show the number of years records need to kept. The standard practice suggests that pupil records should be kept 5 years after the child has left the school although admission registers would need to kept permanently.
Can anyone offer me the current legal position?
