Email is a means of communication. If an email is generated or received
as part of a business activity, task or transaction and provides
evidence of that activity, task or transaction it's a record and subject
to exactly the same retention rules as the equivalent record in any
other format and needs to be handled accordingly. This may create some
particular technical and management problems but the principle is clear
- 'email records' need to be captured and held in a 'record-keeping'
system.
