First of all I agree with Paul and Andy, having boolean values for
metadata is not particularly helpful and if a value is provided for
6.3, 6.2 is somewhat redundant.
The reason that these two elements are mandatory in the UK LOM Core is
that IPR is continually identified by educational practitioners as
being one of the primary issues that influences their willingness to
share and reuse educational resource.
Mandating both 6.2 and 6.3 does represent a bit of a belt and braces
approach but Gerry and I initially felt it was helpful to provide more
rights information rather than less.
I'd also like to point out that Paul's statement below isn't
necessarily true.

If neither element is mandated an empty 6.3 could just as easily imply
that the metadata creator does not know whether there are rights
associated with an object or that they have chosen to ignore these
rights. (They can be dodgy people these metadata creators you know ;-)
A user confronted with such a resource may understandably be unwilling
to use it.
This issue will require further consideration depending on how we
approach the problem of mandatory elements and conformance.
