The £10 and 40 days is about people requesting access for their own notes.
As far as I am aware the 40 day rule does not apply in this case.
An average cost for notes seems to be around £15-£25 procesing fee and
15-20p per page photocopied with a cap set around the £50 mark.
in my experience payment from solicitors is normally always forthcoming, if
not exactly prompt.

This request for information is NOT about consent for release of notes as
I am aware of all the aspects surrounding consent having discussed this at
lenght in the past.
Like so many of you out there it would appear that solicitors like writing
to me! usually to request oh notes either for work related or non work
related health claims.(car crashes etc)shame none offer me a cut of their
takings!
you may also know that some solicitors ask for notes before a claim has
been submitted and even request notes for several employees in the same
type of job!!! my personal experience says this practice is becoming more
common.(7 requests in one month for the same work area!)'fishing' is what
i like to call it.
i am trying to find if there is a 'common' cost for notes.
i remember reading that for a copy of medical records for the individual a
£10 can be charged, but i am eager to look at 'best practice' and if and
how different companies go about securing payment within the 40 day time
scale for release of notes for occupational disease.
i am also interested in what 'guidance' is commonly used. i understand the
DPA will soon be introducing a section relating to OH notes ,i am
interested to learn what others are doing and their basis for doing so.
